Privacy Notice for Psychological Counselling

The protection of your personal data is important to me. I process your personal data exclusively in accordance with the General Data Protection Regulation (GDPR) and applicable data protection law.

2. Purpose of data processing

Your personal data is processed exclusively to the extent necessary for the initiation, provision and handling of the counselling relationship. This includes in particular:

• Scheduling and communication
• Providing psychological counselling
• Contract handling
• Invoicing and payment processing
• Fulfilling statutory retention obligations

3. Data processed

Depending on the course of counselling, the following personal data in particular may be processed:

• Name
• Address, insofar as required for concluding the contract, invoicing, or statutory obligations
• E-mail address
• Telephone number, if you provide it voluntarily
• Contract and payment data
• Information you voluntarily share with me in the course of counselling

4. Legal bases

Your personal data is processed on the basis of:

• Art. 6 (1)(b) GDPR (contract and pre-contractual measures)
• Art. 6 (1)(c) GDPR (legal obligations)
• Art. 6 (1)(a) GDPR (consent, where required)

5. Website, e-mail and postal address

For the operation of my website and for e-mail communication, I use the hosting and e-mail service provider STRATO AG.

For providing my business address and for receiving and forwarding postal mail, I use Postflex.

These service providers process personal data exclusively within the scope of the respectively required service and in compliance with applicable data protection regulations.

6. Online counselling

Online counselling is conducted via a data-protection-compliant video conferencing service with server locations within the European Union.

On request, or if necessary for conducting the counselling, sessions may also be held via Microsoft Teams or Zoom. In this case, the privacy policy of the respective provider applies in addition; this may result in the processing of personal data outside the European Union.

Counselling sessions are generally not recorded.

7. Payment processing

Payment is made by bank transfer or, if chosen by you, via PayPal. If you pay via PayPal, the privacy policy of the respective payment service provider applies in addition.

8. Disclosure of personal data

Your personal data is generally not disclosed to third parties. Exceptions apply only,

• insofar as this is necessary for carrying out the counselling relationship (e.g. hosting, e-mail communication, mail forwarding, payment processing, or video conferencing service),
• if you have given me your explicit consent,
• if I am obliged to disclose the data due to statutory provisions or an official or judicial order.

My website does not use analysis or marketing cookies. Personal data is not disclosed to third parties for advertising or analysis purposes.

9. Confidentiality

I treat all information you entrust to me in the course of counselling as confidential. Disclosure only occurs in the cases mentioned under item 8.

10. Storage period

Your personal data is stored only for as long as necessary for carrying out the counselling relationship or as required by statutory retention obligations. After the purpose of processing no longer applies and the statutory retention periods have expired, the data is deleted.

11. Your rights

Under the GDPR, you have in particular the right to:

• Access to your stored personal data
• Rectification of inaccurate data
• Erasure of your data, provided no statutory retention obligations apply
• Restriction of processing
• Data portability
• Object to the processing of personal data, insofar as the statutory conditions are met
• Withdraw any consent given, with effect for the future
• Lodge a complaint with a competent data protection supervisory authority

To exercise these rights, an informal e-mail to contact@empathy-to-life.net is sufficient.

12. Data security

I take appropriate technical and organizational measures to protect your personal data from loss, misuse, unauthorized access or unauthorized disclosure. The technical services used are carefully selected and employed with due regard to data protection requirements.
